Terms of Use

1 · Who we are, and who we are not

Transit Barometer ("we", "us") is an independent publisher operating from Ontario, Canada. We republish and analyse travel and border information that government agencies make publicly available.

2 · Where our data comes from — and what it is not

This section matters, so it is explicit.

• We collect only from public, official sources. Every figure originates from data a government agency or public authority has itself published for public access — open-data releases, published machine-readable feeds, and public status boards.
• We rely on the licences those bodies grant. Canadian federal data is used under the Open Government Licence – Canada; U.S. federal government works are in the public domain; other sources are used as their published terms permit. Each page names its source.
• We do not access restricted or private systems, we do not circumvent access controls, and we do not use credentials, paid feeds or non-public interfaces to obtain any of it.
• We do not collect data from individuals. We hold no traveller records. Everything we publish is operational and aggregate — queue times, counts, service status — never information about a person. We do not knowingly publish personal information, and would remove any that ever appeared in a source.
• Official marks are not ours. Agency names, crests, logos and official symbols belong to those bodies. We name agencies only to identify the source of data, which is nominative use and not a claim of association.

As the Open Government Licence itself provides, the originating information provider supplies its data "as is" and excludes its own warranties and liability. We cannot and do not warrant data we did not create. If you believe a source is misattributed or improperly used here, tell us at once through the contact page and we will investigate promptly.

3 · No warranty — please read this part

In plain terms: wait times, cancellations, ground stops and similar operational information change constantly. They can be wrong, stale, incomplete or missing — frequently because the agency’s own feed is wrong, stale, incomplete or missing, which is entirely outside our control. Coverage is uneven and some locations publish nothing at all. Our boards are not real-time; sources typically publish about hourly.

5 · Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, TRANSIT BAROMETER AND ANYONE ASSOCIATED WITH IT WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE OR EXEMPLARY DAMAGES, OR FOR ANY LOSS OF PROFIT, REVENUE, DATA, GOODWILL, MISSED CONNECTIONS, DELAY, MISSED APPOINTMENTS, OR BUSINESS INTERRUPTION, ARISING OUT OF OR CONNECTED WITH YOUR USE OF, OR INABILITY TO USE, THIS SITE OR ITS INFORMATION — WHETHER IN CONTRACT, TORT (INCLUDING NEGLIGENCE), STATUTE OR OTHERWISE, AND EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH LOSS.

WHERE LIABILITY CANNOT LAWFULLY BE EXCLUDED, OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS IS LIMITED TO ONE HUNDRED CANADIAN DOLLARS (CAD $100).

Some jurisdictions do not allow certain exclusions or limitations, so parts of this section may not apply to you. In that case our liability is limited to the least extent the law permits.

6 · Your reuse licence, and your indemnity to us

Our analysis, rankings, charts and written content are licensed CC BY 4.0 — free to reuse, including commercially, with attribution (see how to cite us). Underlying government data remains subject to its own licence, named on each page. The Transit Barometer name, logo and visual identity are not covered by that licence and may not be used to suggest we endorse, supply or approve you or your product.

If you republish, redistribute or build on our content, you are responsible for how you use it — including keeping attribution accurate, not presenting our figures as real-time, and not attributing our analysis to a government agency. You agree to indemnify and hold us harmless from any claim, damage, loss or expense (including reasonable legal fees) arising from your use, republication or modification of our content, or your breach of these terms.

7 · The embeddable widget

Our border wait-time widget may be placed on any website free of charge, including commercial sites, on these conditions:

• the attribution link back to Transit Barometer that ships with the widget stays intact and visible;
• you do not modify it to alter, hide, delay or misrepresent the figures it displays, or to imply official status;
• you accept it is provided AS IS with no uptime, accuracy or continuity guarantee, and may change, break or be withdrawn at any time without notice;
• you remain solely responsible to your own visitors for everything displayed on your site, including our widget, and you indemnify us against claims brought by them.

8 · Acceptable use

• Do not use this site in any way that damages it, overloads it, or disrupts its availability for others.
• Automated access is permitted if it is reasonable: identify yourself honestly in your user-agent and do not request more often than our data changes. Our boards refresh every 5–10 minutes, so a faster crawl gains you nothing and may be blocked.
• Do not present our content as your own, as a government publication, or in a way that misleads about its source, age or meaning.
• Do not use this site for any unlawful purpose.

9 · Availability and changes

We do not guarantee the site will be available, uninterrupted or error-free, and we may change, suspend or discontinue any part of it — including any dataset, board or the widget — at any time without notice. We are not liable for any failure or delay caused by events beyond our reasonable control, including source-agency outages, network or hosting failures, or acts of government.

10 · Links to other sites

We link to agency, airport and consortium pages so you can verify what we publish. We do not control those sites, do not endorse them, and are not responsible for their content, accuracy or availability.

11 · Copyright and takedown

If you believe anything published here infringes your rights, contact us with the page address, what is affected and the basis of your claim. We investigate promptly and remove or correct anything we should not be publishing. We would always rather fix it than argue about it.

12 · General

• If any provision of these terms is held unenforceable, the rest remains in force.
• Our not enforcing a term is not a waiver of it.
• These terms, with the pages they reference, are the entire agreement between us about this site.
• We may update these terms; the date below shows the current version and material changes are noted here. Continuing to use the site after a change means you accept it.

13 · Governing law and jurisdiction

These terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable there, without regard to conflict-of-law rules. You agree the courts of Ontario have exclusive jurisdiction over any dispute arising from them, subject to any non-waivable right you have to bring a claim where you live.
